1. Acceptance of Terms

By accessing or using the BeyondClass platform (including our website at beyondclass.app and any associated mobile applications), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

BeyondClass is operated by Fitzgerald Ventures Sdn. Bhd. (Company Registration No. 202501020554), a company incorporated in Malaysia.

2. Description of Service

BeyondClass is a marketplace platform that connects parents and guardians ("Parents") with enrichment activity providers ("Providers") in Malaysia. Our platform enables Parents to discover, compare, and book enrichment classes and activities for their children.

BeyondClass acts as an intermediary platform. We are not the provider of enrichment activities and do not employ the instructors or teachers who deliver classes. The contractual relationship for any booked activity is between the Parent and the Provider.

3. User Accounts

To use certain features of BeyondClass, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to create a Parent account on BeyondClass. Children do not create accounts — all activity on behalf of children is managed by their parent or legal guardian.

4. Bookings and Payments

When you book an activity through BeyondClass, you are entering into a direct agreement with the Provider. BeyondClass facilitates the booking and payment process but is not a party to the agreement between you and the Provider.

All prices displayed on BeyondClass are set by the Providers. BeyondClass does not charge Parents any fees for using the platform — our service is free for families.

Bookings, cancellations, refunds, no-shows and rescheduling are governed by our Booking, Cancellation & Refund Policy.

5. Provider Verification

BeyondClass undertakes reasonable steps to verify Providers listed on our platform, including checking business registration, instructor qualifications, and facility standards. However, our verification process does not constitute a guarantee of quality, safety, or suitability.

Parents are encouraged to conduct their own due diligence when selecting enrichment activities, including visiting facilities, meeting instructors, and attending trial classes where available.

6. Intellectual Property

All content on the BeyondClass platform — including text, graphics, logos, images, software, and the compilation thereof — is the property of Fitzgerald Ventures Sdn. Bhd. or its content suppliers and is protected by Malaysian and international copyright laws. Unauthorised reproduction, distribution, or use of any content from BeyondClass is strictly prohibited.

7. Limitation of Liability

To the fullest extent permitted by Malaysian law, BeyondClass and Fitzgerald Ventures Sdn. Bhd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform.

BeyondClass does not guarantee the availability, accuracy, or completeness of any information provided by Providers on the platform. We are not responsible for the quality, safety, or legality of the activities offered by Providers.

8. Privacy

Your use of BeyondClass is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA).

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or relating to these terms or your use of BeyondClass shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of BeyondClass after any changes constitutes acceptance of the revised terms.
